Welcome to Spark. These Terms of Service govern your use of our dating app and the services we provide. Please read them carefully before creating an account.

Report an unauthorized charge or billing dispute. This process is available without signing in.

Acceptance of Terms

  • Spark is operated by Syndicate Hub LLC. These Terms of Service are an agreement between you and Syndicate Hub LLC, and they govern your use of the Spark app and services.
  • By creating an account or using Spark, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, you may not use the app.

Eligibility

  • You must be at least 18 years old to use Spark. Accounts we learn belong to someone under 18 are terminated.
  • You must be legally able to enter into these Terms, and you must not be barred from using the service under the laws that apply to you.
  • Spark is a general-audience dating service, not a service for minors, and it is not intended for use by anyone seeking relationships with minors.

Your Account

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You agree to provide accurate information during registration, including your real birthdate and identity, and to keep it current.
  • One person may not create multiple accounts or share an account with others. Impersonating someone else is prohibited.

Acceptable Use

  • You will not harass, threaten, stalk, or impersonate any person or entity.
  • You will not upload false, misleading, or copyrighted photos that you do not have the right to use.
  • You will not use Spark for any illegal or unauthorized purpose, including spam, scams, solicitation, sex work, or trafficking.
  • You will not attempt to reverse engineer, scrape, automate, or disrupt the service, its data, or the reward systems.
  • You will not use the app to contact or exploit anyone under 18, in any form.
  • You will follow our Community Guidelines, which supplement these Terms.

Profiles and Content

  • You retain ownership of the content you post, but you grant Spark a worldwide, non-exclusive, royalty-free license to host, store, display, and resize that content within the app so the service can operate.
  • We reserve the right to remove profiles or content that violate these Terms or our guidelines, and profiles flagged for review may be temporarily hidden pending moderation.
  • You are responsible for the content you post and the messages you send. Do not post content you do not have the right to share.

Copyright Complaints

  • If you believe content on Spark infringes your copyright, send a notice to syndicatehubllc@gmail.com with the subject "Copyright notice", including: your contact details, identification of the work and the infringing content, a statement that you have a good-faith belief the use is unauthorized, a statement under penalty of perjury that the information is accurate and that you are the owner or authorized agent, and your physical or electronic signature.
  • We will remove or disable access to material that is the subject of a valid notice, and we will notify the affected member so they can respond. Repeated infringement results in account termination.

Subscriptions and Payments

  • Spark Premium is a monthly subscription billed through Base44 Payments, which is our payment provider’s checkout. Pricing, billing period, and any discount are displayed on the subscription page before you pay.
  • Verified members may receive a discounted rate. Discounts are applied automatically based on your verification status.
  • Subscriptions renew automatically each month at the price shown at checkout until you cancel. By subscribing you authorize us and our payment provider to charge your payment method on a recurring basis.
  • You can cancel at any time from the app or by contacting us, and you retain access until the end of the current billing cycle. Canceling stops the next renewal; it does not retroactively refund the current period.
  • Super Like bundles, credit packs, and boosts are one-time purchases. Any general non-refundable terms remain subject to unauthorized-charge claims and applicable consumer rights.
  • If we offer a promotional period or trial, its terms and end date are shown at checkout, and you must cancel before it ends to avoid being charged.
  • Refunds for subscriptions are handled according to applicable consumer protection laws. See our billing dispute process for unauthorized charges and billing errors.

Rewards, Credits, and the Invite Ladder

  • Swipe credits, like-view credits, lounge chips, trophies, and banked free months are promotional benefits provided by Syndicate Hub LLC. They have no monetary value, are not property, cannot be exchanged for cash or transferred between accounts, and may be adjusted, capped, or discontinued at our discretion.
  • Invite rewards are earned when a friend signs up with your link and is credited as a genuine new member. Each friend counts once. Inviting yourself, creating duplicate or fake accounts, using disposable or shared identities, or automating invites to farm rewards is prohibited.
  • If we find that rewards were obtained through fraud, abuse, or a violation of these Terms, we may reverse the rewards, remove trophies and banked months, and suspend or terminate the accounts involved.
  • Daily limits, per-day caps, balance ceilings, and milestone thresholds are part of the program and are applied by our systems. Where a milestone provides a free month of Premium, it is banked until claimed, has no expiry while your account is in good standing, and has no cash value if unclaimed.
  • Rewards and invite balances tied to an account end when that account is deleted or terminated.

Safety and Moderation

  • Spark uses photo verification, member reports, blocks, and automated signals to keep the community safe.
  • We may warn, restrict, suspend, or ban accounts that violate these Terms or our Community Guidelines, and we may remove content.
  • You are solely responsible for your interactions with other users. Spark does not conduct criminal background checks on members and does not guarantee that any information a member provides is accurate. Take normal safety precautions when meeting anyone in person.

Third-Party Services and App Stores

  • Spark runs on third-party infrastructure and payment services, and the mobile apps may be distributed through the Apple App Store or Google Play. Your use of those stores and services is also subject to their own terms.
  • Where you obtained the app from the Apple App Store, Apple is not a party to these Terms and has no obligation to provide maintenance or support for the app, and Apple is a third-party beneficiary of these Terms with the right to enforce them.
  • Purchases made through an app store are billed by that store and are subject to its refund policies rather than ours.

Disclaimers

  • Spark is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not guarantee uninterrupted or error-free service, and we do not guarantee that you will find a match.
  • We are not responsible for the conduct of any member, on or off the app.
  • You use Spark at your own risk. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of Liability

  • To the maximum extent permitted by law, Syndicate Hub LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Spark.
  • Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (US$50).
  • Nothing in these Terms limits liability that cannot be limited by law, including for fraud, willful misconduct, or death or personal injury caused by negligence, and nothing limits your statutory consumer rights.

Indemnification

  • You agree to indemnify and hold harmless Syndicate Hub LLC and its officers, employees, and agents from claims, damages, losses, and reasonable legal costs arising from your content, your use of the service, or your violation of these Terms or the rights of another person.
  • We will notify you of any such claim and may participate in its defense. This obligation does not apply to the extent the claim results from our own wrongdoing.

Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules.
  • If a dispute arises, please contact us first at syndicatehubllc@gmail.com with a description of the problem and the outcome you are seeking, so we can try to resolve it informally within 30 days.
  • If we cannot resolve it, you and we agree to the exclusive jurisdiction of the state and federal courts located in Colorado, except that either party may bring a claim in small-claims court, and nothing here prevents you from bringing a claim in a court where you have a non-waivable right to do so.
  • Nothing in this section prevents you from contacting a regulator or consumer protection authority, or from using your payment provider’s dispute process.

Termination

  • You can request account deletion at any time from Settings or by contacting support; our account deletion page explains exactly what is removed, what we are required to keep, and how to cancel a subscription first. The request is reviewed before fulfillment; submitting it does not immediately close your account or delete its data. We will confirm the outcome.
  • We may suspend or terminate your account if you violate these Terms, if required by law, or if your account poses a risk to other members. Where practical, we will tell you why.
  • Upon termination, your right to use Spark ends immediately, and any unused rewards or invite balances are forfeited.

Changes to These Terms

  • We may update these Terms from time to time. We will notify you of significant changes through the app or by email, and we will update the date at the top of this page. Continued use after changes constitutes acceptance.
